Terms of service

These terms cover Atypic’s subscription software apps and the paid plans you buy for them. Please read them: by creating an account or buying a plan, you agree to them.

01Who we are

Atypic (“Atypic”, “we”, “us”) is a software business based in Alaska, United States. We make subscription software apps that you use online, listed on our products page. Today that is Bookwright, at bookwright.diy. In these terms, “the apps” means those apps, and “you” means the person or organization using them.

02Your account

  • You must be old enough to make a binding contract where you live (18 in most of the United States) to create an account or buy a plan. If you use an app for an organization, you confirm you may accept these terms for it.
  • Give us an email address you control. Apps such as Bookwright sign you in with codes sent to it, so anyone who can read that inbox can reach your account. Keep it secure, and tell us at support@atypic.ai if you think someone else has used your account.
  • You are responsible for what happens in your account, including what the apps do on your instructions.
  • You can delete your account at any time, in the app or by asking us.

03Your content

What you write, upload or make in the apps is yours. You give us permission to store, process and display it only as needed to run the apps for you: for example, to save your book, send it to the AI provider you choose, and produce the files you ask for. We don’t sell your content, and we don’t use it to train AI models.

You confirm you have the right to use what you bring into the apps, such as a manuscript or pictures, and that using it in the apps won’t break the law or anyone else’s rights.

04AI providers and AI output

Some apps, including Bookwright, run on an AI provider you choose and pay for yourself, with your own key or plan. Your use of that provider is under its own terms and its own charges, which are not part of any Atypic plan.

AI output can be wrong, incomplete or similar to existing work. Review what the apps produce before you rely on it, publish it or send it to anyone. You are responsible for what you publish.

05Acceptable use

You agree not to use the apps to:

  • break the law, or help anyone else break it;
  • infringe copyright, trademark or other rights, or publish someone else’s work as your own;
  • make or share material that sexualizes minors, harasses or threatens people, or promotes violence;
  • send malware or spam, probe or break our security, or get into accounts or data that aren’t yours;
  • overload the apps, scrape them, or get around a plan’s limits, for example with several free accounts;
  • copy, resell or rent out the apps or access to them, or reverse engineer them except where the law allows it.

You also may not use the apps where United States law forbids it, such as from an embargoed country, or if you are on a U.S. government list of restricted parties.

06Plans and prices

Each app has a free plan and may have paid plans. What each plan includes, and what it costs in US dollars, is on the products page and in the app before you buy. Paid plans are billed monthly or yearly, as you choose at checkout. Any sales tax, VAT or GST is worked out at checkout from where you live, and shown before you pay.

Paid plans are processed and sold through Link. Sold through Link, LLC (“Link”), an affiliate of Stripe, is the merchant of record: it resells Atypic’s software, takes your payment, collects the tax due on it, and sends your receipts. Checkout is on Stripe’s payment page, the purchase is shown as “Sold through Link”, and your card statement reads LINK.COM* ATYPIC.

Your purchase is also covered by Link’s terms for purchases sold through Link. Link handles questions about a payment, a charge or a refund, under its own policies, at support.link.com. Atypic remains responsible for the apps themselves: delivering them, how they work, and supporting you at support@atypic.ai.

If the way we sell a plan changes, for example to a different merchant of record, we’ll tell subscribers by email before it affects their next charge.

08Automatic renewal

A paid plan is a subscription for one month or one year. It renews automatically at the end of each term, for another term of the same length, and the renewal is charged to the payment method on file, until you cancel. It renews at the price you subscribed at. If that price is going to change, we’ll email you before the change applies to you, so you can cancel first if you don’t want to continue. Before a yearly plan renews, Link emails you a reminder.

If a renewal payment fails, the payment may be retried and you may be asked to update your payment method. If it still can’t be collected, the plan ends and your account moves to the free plan.

09Cancelling

You can cancel a paid plan at any time: in the app (in Bookwright, choose Manage billing on the account page, which opens the billing portal) or at link.com. Cancelling stops the next renewal. It takes effect at the end of the term you’ve already paid for: the paid plan stays on until then, you aren’t charged again, and your account then moves to the free plan. Your account and your work stay, within the free plan’s limits.

10Refunds

Refunds are covered by our refund and cancellation policy. Link may also issue a refund within 60 days of a purchase under its own refund policy, even where ours would not.

11Changes to the apps

We improve the apps over time, which means features change. If we make a change that takes away a material part of a paid plan during a term you’ve paid for, we’ll tell you, and you can cancel and ask us for a refund of the unused part of that term.

12Suspension and ending

We may suspend or close an account that breaks these terms, puts other people or the apps at risk, or that the law requires us to close. Where we reasonably can, we’ll tell you first and give you a chance to fix the problem and download your work. If we close your account without you having broken these terms, we’ll refund the unused part of a paid term.

If we ever stop offering an app, we’ll give subscribers at least 30 days’ notice, time to download their work, and a refund of any unused paid time.

13Disclaimer of warranties

The apps are provided “as is” and “as available”. To the fullest extent the law allows, Atypic disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the apps will be uninterrupted, error-free or secure, or that their output will be accurate.

14Limitation of liability

To the fullest extent the law allows, Atypic will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the apps or these terms. Atypic’s total liability for all claims arising from or related to the apps or these terms is limited to the greater of the amount you paid for the app in the 12 months before the claim arose, or US$50.

Some places don’t allow these exclusions or limits, so they apply to you only as far as the law where you live allows. Nothing in these terms limits rights you have as a consumer that can’t be waived.

15Governing law

These terms are governed by the laws of the State of Alaska, United States, without regard to its conflict-of-law rules. Any dispute about them or the apps will be decided in the state or federal courts located in Alaska, and you and Atypic agree to those courts’ jurisdiction. If you are a consumer, you may also have the right to bring a claim where you live. Before going to court, please write to us at support@atypic.ai: most problems are solved faster that way.

16Changes to these terms

We may update these terms. The date at the top says when they last changed. If a change matters to you, for example to how plans renew or are cancelled, we’ll email you before it takes effect. Using the apps after a change takes effect means you accept the new terms; if you don’t, you can cancel and delete your account.

17General

These terms, with the privacy policy and the refund and cancellation policy, are the whole agreement between you and Atypic about the apps. If a part of them can’t be enforced, the rest still applies. Not enforcing a part right away doesn’t mean we give it up. You may not transfer these terms without our consent; we may transfer them to a business that takes over the apps, such as a company Atypic becomes part of.

18Contact
